1. General information

The following terms and conditions apply at FAXURY APS. Please read these terms and conditions carefully before placing your order.
 

2. Ordering, changes & Cancellations 

www.faxury.com is open 24 hours a day, and consequently, you can shop almost any time. However, the shop may be closed down due to maintenance. You can only make purchases when the shop is open and accesible.
 
In order to shop at www.faxury.com you must be at least 18 years of age and possess a valid payment card accepted by us. If you have not yet attained the age of 18, you can still purchase items if you have obtained the consent of your guardian or in another manner have a legal right to make the purchase. You are responsible for providing correct information to Faxury.
 
You select the items you want to buy and add them to the “shopping basket”. Up until the time of order is made you may change the contents of the shopping basket and you can continuously check the contents of the basket and the price of the products. Any additional payments for e.g. shipping will not be calculated until immediately before you are ready to pay.
 
Once you are ready to order, you click “go to cart/basket” where you enter your name, address, email, telephone number, select type of delivery, and enter your payment information.
You may change the contents of your cart/basket right up until the time to confirm your purchase. The purchase is confirmed by clicking the button “Pay now”. Your order is subsequently approved and order confirmation will be sent to your via email.
The amount is not charged from the payment card until the order leaves our warehouse.
 
Please note that subsequently it is not possible to cancel or change placed orders. We reserve the right to price- and printing errors on the website and reserve the right to cancel the order if there is a significant and/or obvious error.
 
2.1  Receipt of order and order confirmation
Once you have placed an order with us, you will receive a receipt via email confirming the receipt of your order. A binding purchase agreement is entered into, when you have received an order confirmation from us.
 

3.  Prices and payment

The stated prices are final prices (totals) and include any applicable delivery charges and value added tax (VAT) at the applicable statutory rate.
Delivery charges and any other costs which might apply will be charged in addition and are clearly displayed during the checkout process. Delivery costs may vary from country to country and are added to each order. In addition depending on your international country, you may be charged for customs and import charges as your order passes through customs. Any charges on a parcel must be paid by you (or the third party that acquires, physical possession of the items you purchased).
 
We reserve the right to change prices from day to day without prior consent, including errors in prices, descriptions, details and updating information.
We are under no obligation to supply a product to you at the incorrect price, even if you have received an order confirmation from us. We hereby reserve the right to cancel all orders or parts of your order if the product is either not available or not available at the price of the item. If the above affects your order, we will notify you immediately. You will be sent a message via e-mail. In the event that you do not hear from us, the order will be considered canceled and we will refund you in full.
 
When using vouchers, you will be charged for the actual amount and any discounts will be deducted at the end of the basket. Reservations are made for price errors and sold-out/discontinued items.
 
We offer and accept the following payment methodes:

During the payment process, you can see which payment methods are available for your country. Delivery charges and any other costs that may apply will be charged in addition and are clearly displayed during the checkout process.
 

4. Shipping & Delivery

Your order will always be dispatched within 2-3 week days. Your shipment will be delivered to the delivery address provided during the order. We only deliver to pickup points, and residential addresses. The expected shipment date for the products is stated in the order confirmation email you have received. In addition to the purchase price of your product, you will be charged for delivery costs, which are clearly indicated where applicable and included in the “Total Price” section at checkout.

FAXURY ApS aims to dispatch orders received before 12:00 PM on the same day. Orders placed after that time will be sent on the next business day. Deliveries are made on all weekdays. Your shipment will be delivered within 2-3 business days of the order in Denmark and 3-7 business days internationally. We offer free delivery to pickup points for orders over 499 DKK. Shipping rates start from 50.00 DKK for orders under 499 DKK. Free shipping is only applicable for deliveries within Denmark. Our delivery services cover nationwide locations within Denmark. We also provide international delivery options to various countries within the Europe.

 

Delivery Options Overview

For your convenience, we provide a range of delivery options across Denmark and Europe. Prices for delivery are applicable to both Denmark and EU destinations.

 
 

Your items are shipped with GLS, and all our packages are insured with a track & trace number. You will receive a tracking number via email and SMS as soon as your package is dispatched. The delivery costs for international shipments depend on GLS’s international shipping rates. For International deliveries, the charges vary from country to country, ranging between 100-300 DKK. Special delivery conditions may apply to certain items. The conditions will be specified prior to purchasing these items. Longer delivery times can be expected during sales and holidays.

 
NOTE: If there is no space at the pickup point, the package will be moved to the nearest pickup point, and you will be notified accordingly. If you encounter any problems, please contact customer service.
 

5. Warranty

We provide a 24-month warranty in accordance with the Sale of Goods Act. Our warranty covers material defects, faulty goods, repairs, and price reductions based on the defect’s severity. Depending on the situation, you have the option for item repair, a refund, or a price reduction. It is important to note that the warranty does not extend to errors or damages resulting from improper handling of the product. Consequently, wear and tear on seams, rivets, zippers, as well as discoloration, and damage from liquids like hand sanitizer or water are not covered if the item has endured the expected level of use.

To ensure coverage under the warranty, you must promptly report any defects once discovered. Please be aware that FAXURY ApS will not cover the costs associated with returning the item.

When initiating a warranty claim, it is essential to reach out to us prior to returning the item. In your email, kindly provide the following information to facilitate the claims process:

  1. A brief description of how the defect occurred.
  2. The date you first noticed the defect.
  3. Attach pictures of both the defect and the entire product, capturing both the front and back.
  4. Include the product name, article number, size, and colour.
  5. Send an invoice or documentation of your purchase.

Once we receive your inquiry, we will process your warranty claim promptly and provide you with a response.

6. Refunds

Once we have processed your return, the amount will be refunded to the original payment method used in connection with the purchase. In the case of a depreciation for which you are liable, the purchase amount will be deducted. 
 
We will refund all payments received from you, except for the delivery cost (excluding any additional costs resulting from your choice of a delivery method other than our standard delivery we offer ). Refunds will not include any potential customs and import charges paid within 14 days from the date we received notice of your decision to exercise the right of withdrawal. Once your return arrives at our warehouse and has been processed by us, we will issue the refund. It may take up to 14 days from the time you return your item. Once we have processed your return, you will receive your refund within 3-5 business days. The refund will be transferred to the same payment method used in the original transaction, minus any shipping costs, unless you have expressly agreed otherwise. We reserve the right to withhold the refund until we have received the returned item, unless you provide us with documentation of having returned it.
 
Please send the item back to us without undue delay and no later than 14 days from the day on which we are informed about your decision to withdraw. As soon as your return reaches our warehouse and is handled by us, we will process the refund. It may take up to 14 days from the time you send your item back. Once your return has been processed, you will receive your refund within 3-5 business days. The refund will be transferred to the same payment method used for the original transaction, minus the shipping costs, unless you have expressly agreed otherwise.
 
We reserve the right to withhold the refund until we have received the returned item, unless you provide us with documentation of its return.”
 

7. Right of withdraw

As a consumer, you have the right to withdraw from a contract with us within 14 days without providing any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the items you purchased. Please note that you must bear the return costs yourself.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal written statement. 
 
Please contact us via mail at costumerservice@faxury.com. You may also use the attached withdrawal form. In your message, you must clearly indicate that you wish to exercise your right of withdrawal.
To meet the withdrawal deadline, it is enough for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. If you want to send the item back to us, you must fill in the return slip and send the item to us.
 

7.1 Standard cancellation form

7.2 Exceptions to the right of withdrawal
 
Please note that your right of withdrawal cannot be exercised solely by refusing to accept the goods without concurrently providing clear notification of this decision.

There are specific instances where the right of withdrawal does not apply:

  • Customized or Personalized Items: Goods that have been made according to the consumer’s specifications or that bear a distinct personal touch are exempt from the right of withdrawal.
  • Sealed Goods: In cases where the sealing of goods is broken after delivery, sealed items that are unsuitable for return due to health or hygiene reasons are not covered by the right of withdrawal.
  • Original Tags and Sealing: For a full refund to be processed, items must be returned with their original tags intact. The sealing on items, if applicable, must also remain unbroken.

Please note that the delivery charges will be on the buyer’s account. Should you require further information or clarification on our return policies, please do not hesitate to contact us. We are committed to ensuring clarity and ease in your transactions.

 

8. Right of Return

You always have a full 14-day right of return from the day you receive your order. You must return your order without undue delay and no later than 14 days after exercising your right of withdrawal. You are responsible for the direct costs associated with the return. 
 
If you wish to return the item to us, you must register your return on our return portal at https://www.gls-returns.com/#/m/faxury.dk. Then enter your email address and order number used at the time of purchase. Select the items you wish to return along with the reason for the return. Subsequently, you will receive a return label via email that you can use to send the item back. Affix this label on the shipping packaging, covering the original shipping label. Please fill out the enclosed return form and include it in the shipment package. Remember to indicate the correct return code and follow the instructions on how to complete the return on the return form. Additionally, it will facilitate the process if you also enclose a copy of the order confirmation or other documentation of your purchase.

You are responsible for the return shipping costs, which will be deducted when purchasing the return label in the return portal. You are responsible for the direct costs associated with return, including a return package price of 49 kr. in Denmark. Please note that the international return charges vary from country to country. If you wish to return the item to us, you need to register your return on our return portal. When returning, please ensure that the item is properly packaged, preferably in the same packaging as it was received. We prefer that the item is returned in unused condition with the original price tags intact. You must return the item to us within 14 days of receipt. Your refund for the returned items will be processed once your order is received and processed. If you want a different item, please place a new order. To avoid extended return processing time, always send your package with the return form. When returning, make sure that the goods are securely packaged, as you are responsible for the package/items until we receive it. Therefore, keep the postal receipt and (track & trace) shipping number. 
 
In the event that you do not collect your package from the pick-up point, you will be charged a handling fee of 60 DKK. Please note that we do not accept packages sent cash on delivery.”
 

8.1 Exchange

We do not offer direct product exchanges. If you want to exchange for a different size, model, or colour, please return the product and place a separate order for the desired product. You need to visit our website and register your return within 14 days from the date you received your order. After that, you should send the unwanted item(s) back to us. We will refund the amount for the unwanted item(s) within 14 days after receiving the product at our warehouse. You are responsible for the item until we have received it back.”
 

8.2 Condition of the item upon return

You are only liable for any deterioration in the value of the goods which is due to handling other than what is necessary to determine the nature, qualities and way of functioning of the goods. In other words, you can try the product as if you were trying it on in a physical store.
 
If the item is tested or handled in ways other than described, it will be considered used. This means that if you regret the purchase, you may receive only a partial refund or no refund at all, depending on the commercial value of the item at the time of the return. To receive a full refund, you must try the item without actually using it.
 

9. Return of international packages

You have a 14-day period to initiate a full return for your order, beginning from the date of its receipt. Please ensure that you return your order promptly and within 14 days of exercising your right to withdraw. You have the option to return the unwanted items, and we will refund the amount through the original payment method used for the purchase. It is not possible to exchange the product directly for another item. You can always return the unwanted items, and we will refund the money to your credit card. You can use the same packaging for the return, and you will be responsible for postage costs when returning the item if you have ordered the wrong size or have regretted your purchase.

If you experience any defects or errors in your item or have received an incorrect item that you did not order, please contact our customer service as soon as possible. We will do our best to assist you. Remember to always provide your order number in your communication with customer service so that we can assist you more efficiently.
 

10. Pre- Orders

Some selected products can be pre-ordered before they are in stock with us. As soon as we have them in stock, we will dispatch your order. At that time, we will reserve the amount on your card until the item is in stock with us. Once we have dispatched your order, we will charge the funds to your card. Estimated delivery dates are indicated on individual products.
If you wish to order other items, they need to be placed as a separate order. It is not possible to combine other items with your pre-order. In such cases, your pre-order will be cancelled, and you will receive an email instructing you to place a new pre-order in a separate order. The rest of your order will be shipped immediately. We are not responsible for any unforeseen delays that may occur in connection with pre-ordering an item. However, please note that the dates provided are not guaranteed, and delays may occur, primarily due to production and customs delays. We will update you as soon as your items are ready for shipment. The rest of the process will proceed in the same manner as mentioned in the above terms.
 
Please note that we are not obligated to deliver your order in the event that our suppliers do not deliver correctly or on time, regardless of whether we have followed the correct ordering procedure. Additionally, it is a condition that we have not assumed the procurement risk in relation to the ordered items. If the specified items are unavailable, we will refund any payment without undue delay.

In order for you to enter into an agreement with us and make purchases on our website, we require the following information from you:

We process your personal information for the purpose of delivering the goods to you and handling inquiries related to your purchase.
